Terms of Use
By installing or using the Evil en Lucifer application or website ("Platform"), you agree to these Terms of Use. If you do not agree, please uninstall the app and stop using the Platform.
1. About the Platform
Evil en Lucifer is an independent digital preservation and music discovery project dedicated to the cultural heritage of Visual Kei music — a Japanese music subculture from the 1980s and 1990s. The Platform's mission is to ensure that historically significant recordings, many of which exist nowhere else, are accessible to fans, researchers, and the cultural community in a legally responsible manner.
The Museum Archive exists to preserve cultural memory and does not compete with official releases or commercial distribution channels. Standard Mode is reserved for authorized or artist-managed content.
2. Definitions
- Platform / App: the Evil en Lucifer mobile application and associated web services at evilenlucifervk.com.
- User: any person who creates an account or accesses the Platform.
- Content: any audio recordings, album artwork, artist information, or related materials available on the Platform.
- Museum Archive: a curated preservation collection of rare and out-of-commerce recordings. Rights status can vary by item; access is restricted and requires acceptance of additional terms.
- Standard Content: recordings explicitly authorized by their rights holders for presence on the Platform.
- Curator / Operator: the Evil en Lucifer project team, the sole party authorized to add or remove content from the Platform.
3. Content Modes
Authorized Content
Recordings with documented authorization from the rights holder or their representative. Clearly labeled as licensed.
Preservation Collection
Rare and out-of-commerce recordings preserved for historical research and cultural appreciation. Free, non-commercial, and access-restricted. Rights remain with their respective holders.
Content status is disclosed in the Platform. Museum Archive material is never labeled "licensed" unless documented authorization has been received. If an item's status changes, we update its label and access conditions.
4. Eligibility and Accounts
You must be at least 13 years old to create an account and use the Platform. Museum Archive access requires an account, explicit acceptance of the additional terms below, and confirmation that you are at least 18 years old.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@evilenlucifervk.com if you suspect unauthorized access to your account.
One account per person. Sharing accounts is not permitted.
5. Museum Archive — Additional Terms
Preservation purpose. The Museum Archive preserves rare and out-of-commerce Visual Kei recordings for historical research and cultural appreciation. Free access does not place any recording in the public domain and does not transfer copyright, related rights, ownership, or a reuse licence to Evil en Lucifer or to you.
Personal streaming only. You confirm that you are at least 18 years old. You may stream available material for personal, non-commercial listening. You may not download, record, copy, redistribute, sell, publicly perform, commercially exploit, or bypass technical access controls protecting Museum Archive material.
Rights and availability. Copyright and related rights remain with their respective holders. Metadata may be incomplete because sources are old, scarce, or poorly documented. Material may be corrected, restricted, frozen, or removed after a curatorial review, a rights review, or a request from a rights holder. Continued availability of any item is not guaranteed.
Your acceptance. We record your account identifier, acceptance timestamp, and terms version as part of our rights-management audit trail. Acceptance grants only personal, revocable access to the Museum Archive; it is not permission to copy or reuse any material.
Rights-holder contact. Artists, former members, heirs, labels, and authorized representatives can request review, correction, restriction, or removal through copyright@evilenlucifervk.com and our Copyright Policy.
6. Permitted Use
You may use the Platform to:
- Stream and listen to available content for personal use, subject to the content mode and applicable terms.
- Browse artist information, discographies, and cultural context.
- Participate in community features (if you have an account).
- Submit feedback, bug reports, and copyright notices through official channels.
7. Prohibited Conduct
You agree not to:
- Download, copy, or redistribute any audio content from the Platform.
- Use the Platform or its content for any commercial purpose.
- Attempt to reverse-engineer, decompile, or tamper with the Platform's software or infrastructure.
- Circumvent any access control, access restriction, or security mechanism.
- Submit false, misleading, or fraudulent copyright notices or takedown requests.
- Impersonate another user, artist, or rights holder.
- Use the Platform in any manner that violates applicable local, national, or international law.
- Scrape, crawl, or extract data from the Platform by automated means.
Violation of these terms may result in account suspension or termination without notice.
8. Content Availability
The catalog is curated and controlled solely by the Evil en Lucifer project team. Content may be added, modified, or removed at any time, including in response to:
- Valid takedown requests from rights holders.
- Rights holder identification and authorization decisions.
- Technical or curatorial decisions.
We do not guarantee the continued availability of any specific recording or album. The Platform is provided "as-is" and "as-available."
9. External Support
The project may receive voluntary external support through independent platforms not affiliated with Google Play (e.g. Ko-fi). Such external support does not unlock in-app features, content, access, or commercial rights within the Google Play version of the app. In-app benefits are unlocked exclusively through the Evil Pro subscription described below.
10. Evil Pro Subscription
Evil Pro is an optional, auto-renewing subscription purchased through Google Play Billing on Android. The current price and billing period (monthly or annual) are shown by Google Play at the time of purchase — that listing is the source of truth, not this document, since pricing may change over time.
The subscription renews automatically at the end of each billing period until cancelled. You can cancel at any time via Google Play → Subscriptions; cancellation takes effect at the end of the current billing period, and Evil en Lucifer does not process cancellations directly.
Refunds for purchases made through Google Play are handled exclusively under Google Play's own refund policy. Evil en Lucifer does not issue refunds directly for Google Play transactions; refund requests must be submitted through Google Play.
Evil Pro benefits may include, and may change over time as the product evolves: an extended daily allowance for Séance Restoration, full manual access to the Advanced Equalizer, a decorative Archive Frame on your profile avatar, and other supporter perks announced in-app. Some early users (founding members, beta testers) may retain Pro benefits under separate grandfathering terms communicated in-app, independent of an active paid subscription.
The Museum Archive and the core Standard catalog remain 100% free regardless of Evil Pro status. Evil Pro is optional support with added benefits — it is not required to access the free catalog, and it does not grant any commercial or ownership rights over Platform content.
11. Intellectual Property
All music, artwork, and recordings available on the Platform remain the property of their respective rights holders. Evil en Lucifer does not claim ownership over any third-party content.
The Evil en Lucifer name, logo, app design, interface, and original software are the intellectual property of the Evil en Lucifer project. You may not use these without written permission.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Platform is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Evil en Lucifer shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
- Evil en Lucifer is not responsible for disputes between third parties (e.g., between former band members) regarding rights ownership over specific recordings.
- Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for Platform services in the 12 months preceding the claim (or USD $10 if you have not made any payments).
13. Content Removal
Rights holders may request removal of their content at any time. We operate a documented, transparent takedown process. See our Copyright Policy for the full procedure.
14. Account Termination
You may delete your account at any time via the app settings or by contacting support@evilenlucifervk.com. Upon deletion, your personal data will be removed within 30 days (subject to data we are legally required to retain).
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.
15. Changes to Terms
We may update these Terms at any time. For significant changes, we will notify users within the app. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Brazil, without regard to conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Comarca de São Paulo, State of São Paulo, Brazil, unless mandatory consumer protection law in your country of residence requires otherwise.
Users in the European Union retain all rights afforded by EU consumer protection law, including the right to pursue claims before courts in their country of residence.
17. Child and Adolescent Safety
The Platform is not designed for children and does not intentionally target children. Social features include consent and moderation flows where applicable.
Users must not post, request, sexualize, exploit, harass, or endanger children or adolescents in any way. Content or conduct involving exploitation, abuse, grooming, sexualization, coercion, self-harm encouragement, gambling, or other serious harm involving minors may be removed, frozen, reported, or escalated as required by law.
18. External Media References (Profile Library)
Users may add references to games, movies, series, or anime to their profile library using third-party metadata providers (IGDB for games; TMDB for movies, series, and anime). These references may include titles, cover or poster images sourced from the external provider, ratings, personal review text, and visibility settings.
Evil en Lucifer does not claim ownership over third-party metadata, cover art, posters, trademarks, or titles. Cover images and posters are loaded directly from the external provider's infrastructure and are not rehosted on our servers.
Reviews you publish publicly are visible to other users and are subject to the same community standards and moderation rules as other user-generated content. You are solely responsible for the content of your reviews. Abusive, harassing, or illegal content may be removed by moderators.
The Profile Library is a personal and social feature. It does not provide access to, stream, or distribute any third-party game, movie, or series content. It is not a premium or paid feature during the Alpha period.
Game data is provided by IGDB. Movie and series data uses the TMDB API — this product uses the TMDB API but is not endorsed or certified by TMDB.
