Terms of Use
By installing or using the Evil en Lucifer application or website ("Platform"), you agree to these Terms of Use. If you do not agree, please uninstall the app and stop using the Platform.
1. About the Platform
Evil en Lucifer is an independent digital preservation and music discovery project dedicated to the cultural heritage of Visual Kei music — a Japanese music subculture from the 1980s and 1990s. The Platform's mission is to ensure that historically significant recordings, many of which exist nowhere else, are accessible to fans, researchers, and the cultural community in a legally responsible manner.
The Museum Archive exists to preserve cultural memory and does not compete with official releases or commercial distribution channels. Standard Mode is reserved for authorized or artist-managed content.
2. Definitions
- Platform / App: the Evil en Lucifer mobile application and associated web services at evilenlucifervk.com.
- User: any person who creates an account or accesses the Platform.
- Content: any audio recordings, album artwork, artist information, or related materials available on the Platform.
- Museum Archive: the collection of orphan works (recordings whose rights holders cannot be identified or located despite documented, good-faith search). Access is restricted and requires acceptance of additional terms.
- Standard Content: recordings explicitly authorized by their rights holders for presence on the Platform.
- Curator / Operator: the Evil en Lucifer project team, the sole party authorized to add or remove content from the Platform.
3. Content Modes
Authorized Content
Recordings with documented authorization from the rights holder or their representative. Clearly labeled as licensed.
Orphan Works
Recordings preserved under a cultural heritage framework after documented good-faith efforts to identify and contact rights holders. Non-commercial. Access-restricted.
Content status is always disclosed in the Platform. We never label orphan works as "licensed." If content status changes (e.g., a rights holder is identified and authorizes the content), we update the label accordingly.
4. Eligibility and Accounts
You must be at least 13 years old to create an account and use the Platform. Museum Archive access is restricted to verified accounts.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@evilenlucifervk.com if you suspect unauthorized access to your account.
One account per person. Sharing accounts is not permitted.
5. Museum Archive — Additional Terms
Accessing the Museum Archive requires explicit acceptance of these additional conditions:
- You meet the eligibility requirements for Museum Archive access.
- You understand that Museum Archive content is orphan works preserved under a cultural heritage framework — not commercially licensed recordings.
- You will use Museum Archive content solely for personal, non-commercial listening, research, and cultural appreciation.
- You will not download, redistribute, or commercialize Museum Archive content in any form.
- You understand that content may be removed at any time if a rights holder is identified and requests removal.
Your acceptance is recorded with a timestamp and terms version number. This record is maintained for compliance purposes.
6. Permitted Use
You may use the Platform to:
- Stream and listen to available content for personal use, subject to the content mode and applicable terms.
- Browse artist information, discographies, and cultural context.
- Participate in community features (if you have an account).
- Submit feedback, bug reports, and copyright notices through official channels.
7. Prohibited Conduct
You agree not to:
- Download, copy, or redistribute any audio content from the Platform.
- Use the Platform or its content for any commercial purpose.
- Attempt to reverse-engineer, decompile, or tamper with the Platform's software or infrastructure.
- Circumvent any access control, access restriction, or security mechanism.
- Submit false, misleading, or fraudulent copyright notices or takedown requests.
- Impersonate another user, artist, or rights holder.
- Use the Platform in any manner that violates applicable local, national, or international law.
- Scrape, crawl, or extract data from the Platform by automated means.
Violation of these terms may result in account suspension or termination without notice.
8. Content Availability
The catalog is curated and controlled solely by the Evil en Lucifer project team. Content may be added, modified, or removed at any time, including in response to:
- Valid takedown requests from rights holders.
- Rights holder identification and authorization decisions.
- Technical or curatorial decisions.
We do not guarantee the continued availability of any specific recording or album. The Platform is provided "as-is" and "as-available."
9. External Support
The project may receive voluntary external support through independent platforms. Such support does not unlock in-app features, content, access, or commercial rights within the Google Play version of the app.
10. Intellectual Property
All music, artwork, and recordings available on the Platform remain the property of their respective rights holders. Evil en Lucifer does not claim ownership over any third-party content.
The Evil en Lucifer name, logo, app design, interface, and original software are the intellectual property of the Evil en Lucifer project. You may not use these without written permission.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Platform is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Evil en Lucifer shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
- Evil en Lucifer is not responsible for disputes between third parties (e.g., between former band members) regarding rights ownership over specific recordings.
- Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for Platform services in the 12 months preceding the claim (or USD $10 if you have not made any payments).
12. Content Removal
Rights holders may request removal of their content at any time. We operate a documented, transparent takedown process. See our Copyright Policy for the full procedure.
13. Account Termination
You may delete your account at any time via the app settings or by contacting support@evilenlucifervk.com. Upon deletion, your personal data will be removed within 30 days (subject to data we are legally required to retain).
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.
14. Changes to Terms
We may update these Terms at any time. For significant changes, we will notify users within the app. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Brazil, without regard to conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Comarca de São Paulo, State of São Paulo, Brazil, unless mandatory consumer protection law in your country of residence requires otherwise.
Users in the European Union retain all rights afforded by EU consumer protection law, including the right to pursue claims before courts in their country of residence.
16. Child and Adolescent Safety
The Platform is not designed for children and does not intentionally target children. Social features include consent and moderation flows where applicable.
Users must not post, request, sexualize, exploit, harass, or endanger children or adolescents in any way. Content or conduct involving exploitation, abuse, grooming, sexualization, coercion, self-harm encouragement, gambling, or other serious harm involving minors may be removed, frozen, reported, or escalated as required by law.
